Coming to a decision about filing bankruptcy

 

The decision to file or not to file a bankruptcy is a difficult one to make. After all, this is a decision that will affect your life for many years to come not matter what you decide. You really have to weigh all the aspects of filing for bankruptcy carefully before you make this tough decision.

If you decide  to hire a lawyer, after your first consultation – which should not cost you anything – your lawyer should be able to flat out whether or not your debt load is enough to make bankruptcy a good outlet for your specific needs. Keep in mind that even if your lawyer says it is on that visit, you will have to know up front whether you can handle the circumstances either way – emotionally and all. Only you can make this decision, no matter what the lawyer says – you have to be in control of your decision making.

On the bright side, for the most part anyway, bankruptcy does not hold the huge overbearing status that it used to for people to bear. The stigma is not as bad as it used to be. Your bankruptcy will not be announced by a tattoo emblazoned on your forehead, but you will have to consider what your behavior about announcing it to acquaintances may be. After all, it may not be a topic for discussion at your next dinner party invite, but you will not be dogged for life either.

If you apply for credit in the future – after filing a bankruptcy – it will come up and you will have to be able to discuss it with would be creditors in the future. You will also need to be ready to provide logical reasons and speak about your personal bankruptcy too. You will have to do this without getting overly emotional and stay on a straightforward keel when discussing it with potential lenders in the future if they ask.

If your lawyer tells you that he would recommend you to file after your initial visit, you have to be able to spend quality time making your actual decision. As we have said before, his has to come from you no matter what the lawyer recommends. When making your decision, think about your after bankruptcy; write down anything that pops into your head as far as questions go. Get answers to these questions too – and make sure you understand them before you pay any legal fees regarding your bankruptcy inquiry. Very importantly, if you are married, you have to discuss all of the issues over with your spouse. You have to include this person in the decision making if they are involved in any way.
