When it comes to bankruptcy, your decision whether or not to file will be a great measure. It is not something to take lightly in any way, shape, or form. If you are considering filing bankruptcy, it is a big decision that must be made. You will want to know everything you possible can about your actual situation and the details regarding your debt before you make any decision. You have to see if a bankruptcy better suits you and if so which type. Your decision will affect your life fro many years to come, so it is in your best interest to be certain of your options before you make any decision. You will want to consider the pros and the cons – the advantages and disadvantages if you are married; you have to discuss it with your spouse. Just understand that there really is not any easy way out when it comes to bankruptcies, but if you are in enough trouble – bankruptcy may be the way to go.

A major advantage to personal bankruptcy is that filing makes it illegal for the credit card companies and such to do any collection activity. This includes foreclosures or repossessions on the debt you owe them. If creditors do call after you have filed, you are obligated to discuss any of this with them whatsoever. All you have to do is give them your case number that you are assigned once you do file. Many times, this will give you a great amount of immediate emotional relief. After all, if you are filing a bankruptcy, you have no doubt spent a few nights not sleeping at least. The emotional pressure you experience before you file may get overwhelming, so when you do file, you will probably experience some relief.

Another thing to understand about bankruptcies is that there is really no longer a great amount of stigma that accompanied bankruptcies before. These days, you are not labeled a loser if you know what I am saying. You never want to enter into bankruptcy lightly, but you don’t have to feel like a total failure when you do file. You are actually taking some responsibility here. Honestly, you will not want to walk around town with a big B (for bankruptcy) on your shirt, but you will not be required to at least!

The biggest advantage by far to filing bankruptcy is the fact that you get to start over with a clean slate. You will be able to stop fretting over your debt. You will be able to rest at night. In fact, you may find that you will not be as physically sluggish as you were when you had creditors calling you every day and night. You may even get into shape and find a better state of mind in general after the weight has been lifted from your bad debts. Many people in serious debt trouble do not realize the physical and mental toll it takes on them. After you file, you may notice that your outlook on everyday life improves. This is by far the best advantage to filing bankruptcy –piece of mind.

One thing you should also understand about filing bankruptcy is that it is not as expensive as you might think. Many people are reserved when it comes to bankruptcy because they think the fees may be out of their reach. If bankruptcy ids the best thing for you, you will find that filing is not too expensive – it is not free, but it can be affordable. If you are down to your last dollar, you will need to be creative as to finding ways to pay for your bankruptcy filing. While you do not need a lawyer to file, we recommend that you get one. Seriously, you need to make sure all of the bases are covered and there is no one better than a bankruptcy lawyer to this for you. Lawyers are not cheap in general, but there are many reputable lawyers out there in your town that provide flat rates for filing your paperwork. This is much better than hiring someone hourly. Just be certain that when you do contact a lawyer that the flat rate will cover any unexpected extra counsel or questions that you may have during the proceedings.
