Bankruptcy (part 2)
Who can file for a bankruptcy?
You do
not have to be insolvent to be able to declare bankruptcy;
you just have to be financially unstable and unable to pay
your bills and or debts. You do not have to prove that you
are bankrupt, but very few people take bankruptcy lightly.
Bankruptcy is designed to meet a specific need of people
that are experiencing difficulties with their finances or
about to become financially unstable.
Many
times, specific drastic circumstances are the reason for
someone filing bankruptcy. Health is definitely one main
reason that people find themselves filing bankruptcy.
Uninsured medical expenses or extended unemployment because
of poor health are probably the most common reasons fro
filing bankruptcy. Another reason is divorce, where filing
bankruptcy is recourse for resolving joint debt either
before or after filing for the divorce. Another common
reason for filing bankruptcy is the breakdown of an
unincorporated small business that is a solitary
proprietorship.
These
drastic unintended circumstances usually become so
overwhelming that bankruptcy ids the best option. They also
represent things that you have little or no control over in
your life. It is a good chance that these types of drastic
events will not reoccur in your life either, so these are
the cases where it is most probable that bankruptcy will be
the right tool for getting you back on track financially in
life.
If you
are filing bankruptcy to get rid of the fact that you have
overextended your self by overspending, it is as if you have
chosen a very difficult road just for the ability to buy a
few nice things. Many of these items you may have purchased
are most likely long gone too. If you are the person filing
fro bankruptcy because you lived beyond your means, you have
to make certain that you do not repeat your actions. If this
is why are considering or filing bankruptcy, this is
something you do have control over. You will need to work
hard to change your attitude about money and debt so that
you can stay away from becoming a bankrupt person again.
When you
file bankruptcy, do not assume that you will be able to sort
through or choose which creditors you pay either. After you
file fro a bankruptcy the law takes over from there and it
will command which creditors get priority and what goes
where. You will not be able to keep your old credit cards
and continue your past spending habits either. Bankruptcy
gives you the chance to get a fresh start, but it will not
give you a clean slate right at once either. So, be sure
about what is actually at hand when it comes to
bankruptcies. There is more than one type of person
