You Cannot Be
Abused if You Owe Money
It used to be that if you owed money people would call and
harass you all hours of the day or night to get you to pay them.
Then they started putting laws in place that limited the hours
that they could call you to between 8 am and 8 pm. Before or
after that they were in big trouble with the government, but
during those hours it seemed that it was anything goes. They
could call you and harass you at work, call your friends and
family members telling them that you owed money, calling you and
threatening legal action like jail – the list is endless of the
things that they would do to get your money.
But the Fair Debt Practice Act changed all of that and set clear
rules and restrictions for collecting debt. They cannot call
before 8 am or after 9 pm, they cannot call you on Sundays, they
cannot threaten you in any way with violence or harm, and they
cannot use profane language when speaking to you. They cannot
publish your name if you refuse to pay and they cannot make
false statements like saying that the amount of money you owe is
more, or that they will arrest you, or say that they are someone
that they are not. They cannot give out false information
regarding you or your debt to anyone, and they cannot request
post dated checks. If they sue you, they must do it near you not
in another state.
The list of your rights and responsibilities under the act are
numerous and if you have found yourself in the position where
